The Wilson Sonsini Privacy and Cybersecurity team will provide an update on the current landscape regarding international data transfers from the UK. Further to Brexit, the European Commission’s new standard contractual clauses cannot be used to accommodate data exports from the UK. The Information Commissioner's Office (ICO) has developed UK-specific clauses which it submitted to the UK Parliament for formal approval on February 2, 2022: Two data transfer tools will be on offer: UK-specific data transfer clauses (“International Data Transfer Agreement”) as well as an addendum to the European Commission’s standard contractual clauses. These new data transfer tools are expected to become effective on March 21, 2022 and are quintessential for companies doing business with the UK.
